Parents of a first-grader with autism challenged the district's proposal to change his placement from a regular kindergarten with supplementary aids and services to a special education classroom for two-thirds of the school day. An administrative law judge that Joel Guest be placed in the full inclusion program. The district appealed, and the district court reversed, ordered placement in a special education classroom for two-thirds of the student's day for the 1998-1999 school year, and declared that neither party was the prevailing party for purposes of awarding attorney's fees. The Court of Appeals reversed and remanded.
